Frontier Reinforcement Project

New Athens Special Protection System
The Special Protection System Engineering, Construction and Implementation Agreement ("Agreement") between Niagara Mohawk Power Corporation, d/b/a National Grid ("National Grid") and New Athens Generating Company, LLC, Original Service Agreement 923, is still currently active, and National Grid reserves its rights under the Agreement to unilaterally remove the SPS at any time after January 26, 2011. National Grid does not expect to exercise its rights under the Agreement to unilaterally remove the SPS at the end of the Interim Period (as defined in Section 3.4 of the Agreement). The next review of the SPS will take place in the second quarter of 2011.
